NATHAN Young was disqualified from driving for four months and fined £350 after being found asleep in his car while unfit through drink.
Young, 19, of Laurel Heights, Banbridge, appeared before District Judge Natasha Fitzsimons at Banbridge Magistrates’ Court, sitting at Newry Courthouse, on November 5.
The court heard that police found Young asleep in a black BMW at Mountview Park, Banbridge, at around 3.40am on September 22.
Officers detected the smell of alcohol and Young failed an evidential breath test, recording 89 on a subsequent breath test. He made no comment in interview before providing a prepared statement.
Defence counsel said Young had been visiting friends and had become worse for wear before deciding to sleep in his car. He had been there for more than an hour before police were called and had been adamant that he would not drive home.
The court heard that his home was less than a mile away. Young had no previous convictions or penalty points and was described as a hard-working young man who worked as a restaurant supervisor. A letter from his employer was also provided.
Judge Fitzsimons said the job reference was helpful as it demonstrated the trust his employer had placed in him by promoting him. She said the offence was very serious and that she could impose 10 penalty points or a 12-month disqualification, but did not consider either an appropriate disposal in the circumstances.
Young was disqualified from driving for four months and fined £350, with a £15 offender levy. He was given 20 weeks to pay.
