Kyle Fitzsimmons, 29, of Linnhurst Park, Drumaness, appeared before District Judge Natasha Fitzsimons at Banbridge Magistrates’ Court, sitting at Newry Courthouse, after a police officer witnessed him holding a phone while driving.

KYLE Fitzsimmons, 29, is accused of using a hand-held mobile phone while driving a lorry in Banbridge.

Fitzsimmons, of Linnhurst Park, Drumaness, appeared before District Judge Natasha Fitzsimons at Banbridge Magistrates’ Court, sitting at Newry Courthouse.

The charge alleges that on September 15, 2026, at the junction of Castlewellan Road and Church Square, he used a hand-held mobile phone while driving.

The court heard that a police officer passing the DAF lorry saw Fitzsimmons holding a phone in his left hand, apparently on loudspeaker. He was said to have pressed the phone against his chest as police passed.

Fitzsimmons was stopped but declined to discuss the matter at the roadside. The court heard he said the phone had fallen and he had picked it up. He had no previous record.

The case was adjourned until November 12 at the request of the defence.
